Terms of Use
These Terms & Conditions (“Terms”) govern your access to and use of the RISER Collective website, any related pages or subdomains, mobile applications, and services provided via third-party platforms (together, the “Platform” or “Service”).
The Platform is owned and operated by RISER HOLDINGS PTY LTD (ACN 655 678 854) (trading as “RISER Collective”) (“RISER”, “we”, “our”, or “us”).
RISER Collective operates a community-based platform that enables members to participate in campaigns, research, surveys, brand collaborations, and content creation opportunities, both online and offline (“Members”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
Acceptance of These Terms
Your use of the Platform is conditional on your acceptance of these Terms.
By registering for an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.
We may update these Terms from time to time. Any changes will take effect once published on our website. Continued use of the Platform after changes are published constitutes acceptance of the updated Terms.
Eligibility & Access
TTo become a Member, you must be at least 18 years old. Certain campaigns, including alcohol or age-restricted promotions, may require Members to be over 25 years old.
Membership is available to residents of Australia, New Zealand, Singapore, Japan, the United States, Canada, and the United Kingdom, unless otherwise stated.
You are responsible for ensuring you have compatible devices and internet access. Any associated costs are your responsibility.
We do not guarantee uninterrupted or location-specific access to the Platform at all times.
Account Registration & Security
To access certain features of the Service, you must create an account and provide accurate, current, and complete information.
By creating an account, you agree that:
- You will create only one account
- You will keep your login details secure
- You will notify us immediately of any unauthorised access or security breach
We reserve the right to approve, suspend, or terminate accounts at our discretion, including where information provided is false, misleading, incomplete, or where account activity breaches these Terms.
Campaign Participation, Approvals & Deliverables
By participating in campaigns:
- You agree to follow campaign instructions, timelines, and briefing requirements provided by RISER.
- RISER will provide campaign briefs and guidelines, but Members retain full creative discretion over content.
- Members must clearly disclose brand partnerships, gifted products, or paid collaborations (e.g., #ad, Paid Partnership) in accordance with applicable laws and platform rules.
- Campaign content must be truthful, original, and not infringe third-party rights. RISER may request edits or removal of content to ensure compliance.
- Members understand that RISER cannot guarantee all participants will post content, though campaign packages outline expected deliverables.
Rewards, Gifts, Vouchers & Promotions
Where campaigns include rewards, gifts, vouchers, or prizes:
- Rewards, gifts, and vouchers are non-transferable, non-exchangeable, and not redeemable for cash unless expressly stated
- Participants are responsible for ensuring delivery and contact details are accurate and up to date
- Any misuse of rewards, gifts, or vouchers, or breach of these Terms, may result in forfeiture
- If a participant becomes ineligible or is unable to continue participating for any reason, the full value of any voucher issued must be refunded to us upon request
- Specific campaigns or promotions may be subject to additional terms and conditions
Intellectual Property
RISER Collective owns all intellectual property in the Platform, including content, branding, design, software, and campaign materials.
By submitting Content, you grant RISER Collective a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, adapt, publish, distribute, and display that Content for marketing, promotional, reporting, and commercial purposes.
You waive any right to inspect or approve the final use of your Content.
Third-Party Platforms & Links
The Platform may integrate with or link to third-party websites or services, including social media platforms.
RISER Collective does not control, endorse, or take responsibility for third-party platforms, their content, or their terms and policies. Your use of third-party services is subject to their own terms.
Payments & Campaign Costs
Where campaigns involve compensation, rewards, products, vouchers, or third-party costs (e.g. postage or handling), you acknowledge that:
- Products or vouchers may be provided upfront solely to enable members to create and deliver campaign content
- Compensation payable to Members will be paid post-delivery of agreed content, in accordance with the relevant campaign contract or statement of work
- RISER may withhold services, rewards, or payments until all contractual and payment obligations have been met
Disclaimer & Limitation of Liability
The Platform is provided “as is” and “as available.”
To the maximum extent permitted by law, RISER Collective makes no warranties regarding the availability, accuracy, reliability, or suitability of the Platform, and is not liable for indirect, consequential, or incidental loss. Nothing limits your rights under the Australian Consumer Law.
Indemnity
You agree to indemnify RISER Collective against any claims, losses, liabilities, damages, or expenses arising from:
- Your use of the Platform
- Your Content or participation in campaigns
- Your breach of these Terms
- Your violation of any law or third-party rights
Suspension & Termination
You may close your account at any time.
RISER may suspend or terminate your access without notice if:
- These Terms are breached
- Your account is inactive for an extended period
- Your conduct harms the community, campaigns, brands, or RISER Collective
- You do not align with the RISER community requirements
Once terminated, you may not re-register without permission.
Security & Misuse
You must not:
- Introduce malware or harmful code
- Attempt unauthorised access to systems or accounts
- Interfere with the operation or security of the Platform
Serious breaches may be reported to relevant authorities.
Legal Disclosure & Compliance
RISER complies with all applicable laws and regulations, including advertising standards, age restrictions for alcohol or other restricted campaigns, and data protection laws. Participation in campaigns is contingent on meeting these legal requirements.
Business Transfers
In the event RISER is acquired, merges, or transfers assets, your information and agreements may be assigned to the new entity.
Governing Law
These Terms are governed by the laws of Victoria, Australia, and disputes are subject to the exclusive jurisdiction of the courts of Victoria.
General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Nothing in these Terms creates an employment, partnership, agency, or joint venture relationship between you and RISER Collective.
